No Laws Apply??? Leicester, like many Cities around the the UK, suffers from the grey unforgiving wheelie bin invasion. 1000's of bins 24 hours a day, all week, all year. An eyesore, an obstruction and a health hazard. Yet, claiming they can only impose a £1000 FINE on offenders, Leicester City Council diligently continue to do nothing about its decade old problem. So what does Section 149 of the Highways Act 1980 mean to Leicester City Council then? Err... nothing... |
Section 149 of the Highways Act 1980 (1) If any thing is so deposited on a highway as to constitute a nuisance, the highway authority for the highway may by notice require the person who deposited it there to remove it forthwith and if he (sic) fails to comply with the notice the authority may make a complaint to a magistrates' court for a removal and disposal order under this section. .... there are six sub-sections of
